By registering and/or using this Website you agree to the following terms, rules and regulations without limitation or qualification (“Terms and Conditions”).
SOLISOL Travel S.L. is a Spanish registered company (CIF) B92858323, C.I.A.N. number: 291551-3 and registered at Calle Decano Antonio Zedano, Nº 3, Portal 2, Oficina Nº10, 29620 Torremolinos.
These Terms and Conditions, together with our Terms of Use and any other written information we brought to your attention before we confirmed your booking, form the basis of your contract with us. Please read them carefully as they set out our respective rights and obligations
INTERPRETATION.
In these booking conditions the following definition shall have the meanings set against them except where the context otherwise requires:
References to “SOLISOL”, “we”, “our” and “us” means Solisol Travel S.L.
References to "you", "your" or “client” include the first named person on the booking and all persons on whose behalf a booking is made (¨the group¨) or any other person to whom a booking is added or transferred.
References to “event” refers to any fully paid activity participated in by you or any accommodation you stay in that is organised by us.
References to "suppliers" or "providers" refers to the contractor used to fulfil the services and activities forming part of the agreed booking; such as a bus company, an activity company, a hotel or a restaurant.
References to “personal data” has the meaning set out in the REGULATION (EU) 2016/679.
You must be over 16 years old in order to navigate through our website, Solisol Travel, and all our sister/partner websites related to Solisol Travel S.L.
References to “booking confirmation email” means the email the client receives after making a booking.
By making a booking, the first name on the booking agrees on behalf of all persons detailed on the booking that:
BOOKING AND PAYMENT.
When you make a booking you guarantee that you have the authority to accept and do accept on behalf of all members of your party, the terms of these booking conditions. The first named person on the booking will be responsible for making all payments due to Solisol Travel. He/she must be at least 18.
Please note: Checking availability on the Website, by email, on social media or over the telephone does not constitute a confirmation of the booking and although we endeavour to be as accurate as possible with our pricing, we reserve the right to change our prices at any point without prior notice, (this may be due to a number of common reasons for example, exchange rates or supplier, hotelier change)
In order to confirm your chosen arrangements, you must, unless stated otherwise at the time of booking, pay a (non-refundable, non-transferable) deposit as detailed on your booking email. The remaining payment to be made no less than six weeks prior to the commencement of the booking or by such date as is specified in the booking email.
In the case of bookings made 6 weeks or less prior to the commencement of a booking, the full amount is payable unless otherwise stated on the booking email.
We cannot guarantee any price until a deposit / payment has been received.
Occasionally, different payment terms and non-refundable deposits may apply to the arrangements that you book with us, where this is the case we will advise you of the applicable payment terms at the time of booking and, thereafter, you must comply with the same.
We reserve the right not to provide the booking or any part thereof until we have received sufficient funds from the client for the supplier to deliver the event.
The binding agreement is made when we have received your deposit/payment and confirmation of the booking will be sent by email to you. The deposit/payment must be paid before the due date as specified in the booking email. The confirmation e-mail you will receive will ask you to to check the details of everything you have booked and to confirm that everything listed is correct.
It is important that you check the confirmation email carefully and report any incorrect or incomplete information to us immediately. Please ensure that names, and location are exactly as stated in your confirmation and that your dates of departure or dates of your event are correct. We have no responsibility for any errors in any documentation except where an error is made by us. You must pay the full balance by the balance due date notified to you. If full payment is not received by the balance due date, we may cancel your booking without penalty and cancellation charges will apply from the date the payment was due.
PAYMENT FEES.
There are no transaction fees for credit or debit cards.
PRICING.
The price of your event is as detailed in the booking email. We reserve the right to change the price on any previous email correspondence sent at any time prior to the issuing of the booking email. All monies referred to are clearly in Euros or British Pounds Sterling.
Holiday insurance is not included in the price of the booking.
Suppliers of events and activities made in the booking may require the client or members of the group to leave a credit card imprint on check-in or, alternatively, to provide a breakage/damage/security/behaviour deposit. These amounts are refunded locally if there is no damage, breakage, misbehaviour or justifiable reason to retain deposit.
Please note, the majority accommodation providers will request a refundable deposit upon arrival and the client should expect this as standard with any hotel, apartment or villa provider. This is normally pre-authorized onto your debit / credit card on your day of arrival and prior to check-in.
Solisol Travel is not held responsible for informing clients of these refundable deposits as accommodation providers may change their deposit procedures without prior notice.
Unless otherwise stated, the payment does not include the cost of drinks, food, admission, transfers, parking charges, porter charges, fees, tips, contributions and/or any other items that are not referred to on the booking form.
ALTERATIONS OR CANCELLATIONS MADE BY SOLISOL TRAVEL OR A SUPPLIER.
It is unlikely that we will have to make any changes to your travel arrangements, as we do plan the arrangements many months in advance. Occasionally we have to make changes, you will be advised of these changes and we reserve the right to do so at any time.
A booking is based on current schedules and service details and consequently may require minor changes to be made. Wherever possible SOLISOL will endeavour to notify the client of any such changes before commencement of the booking. A minor change will be deemed to be any change which, taking into account the information given by the client to SOLISOL at the time of booking, SOLISOL or the Supplier could not reasonably expect to have a significant effect on the confirmed booking. In the event of minor changes, no compensation is payable by us nor do such changes entitle the client to cancel the booking or request an alternative booking.
In the event that there are significant changes to or cancellation of the booking prior to the commencement date of the booking, SOLISOL will as soon as is reasonably practical endeavour to notify the client. In these circumstances the client may accept the change and if applicable a refund of the difference in price between the price of the booking purchased and that of the substitute booking offered by SOLISOL. In the case where the changed booking is inferior to the one booked, the client may cancel the booking and receive a full refund (which will be in full and final settlement of all claims including loss of enjoyment). SOLISOL where possible will endeavour to offer an alternative booking from the range of available services offered by SOLISOL.
Significant changes to the booking will include the following:
In the event of changes to the booking after it has been agreed, SOLISOL will provide the client with an alternative of the same or higher standard in the same or a similar area. The client will have no right to cancel the booking if SOLISOL have offered the client a suitable alternative.
In the event of loss or damage suffered by the booking party or changes to or cancellation of the whole or part of the Booking due to reasons of unusual or unforeseeable circumstances and events beyond SOLISOL's or the Suppliers' control, compensation will NOT be payable. By way of example, due to safety risks, adverse weather conditions, war, riots, civil strife or terrorist activity, industrial disputes, utility blackouts, cyber warfare, natural or nuclear disasters, fire, flood, shortage of water, epidemics, health scares, medical emergency or necessity, unavoidable and or technical problems with transport or equipment, airport closures and similar events beyond our control.
No compensation is payable if the booking is cancelled in whole or part due to an insufficient number of people required to make available the activity or service forming part of the booking.
Cancellation or changes may be made at any time when safety conditions are, in SOLISOL's or its Suppliers' discretion, compromised. If cancellations occur, in such circumstances SOLISOL or its Suppliers will endeavour to make every effort to reschedule in line with client requirements.
ALTERATIONS OR CANCELLATIONS MADE BY THE CLIENT.
If the client wishes to cancel or make any alteration to the booking, the client must notify us in writing by email as soon as is reasonably practicable. Please ensure that you have received written confirmation of any changes to your booking prior to arrival. Whilst we will try to assist, we cannot guarantee that such requests will be met. Amendments and cancellations can only be accepted in accordance with the terms and conditions of the supplier of your arrangements. The supplier may charge the cancellation or amendment charges.
The cancellation charges set below are in accordance with Solisol´s terms and conditions and not that of any supplier. The cancellation charges will apply if the booking is cancelled by the client. The cancellation will only be effective from the date that written notification of cancellation is received by SOLISOL.

* Please note that if your final balance deadline has been set over 42 days in advance of your event, there will be items in the package that don't apply to our standard cancellation terms (as outline above). In this instance all payments made will be non-refundable after this time.
Variations in cancellation charges may apply in non-standard/exceptional circumstances for example with bookings that include the pre-purchase of tickets, specialist personnel, venues and accommodation. The client will be advised of any variations in standard cancellation terms at the time of booking.
If the client wants to amend the booking or the numbers of the group after the booking confirmation email booking has been issued and the amendment is more than 42 days before the commencement of the booking, there is no administration fee but you will incur any charges or costs imposed by the suppliers.
For amendments less than 42 days prior to the commencement of the booking, SOLISOL reserves the right to charge an administration fee of £50 per group per request in addition to any charges or costs imposed by the supplier.
In the event of certain major changes to the booking or the numbers of the group or the dates of the planned booking, this request may be treated as a cancellation of the initial booking and the creation of a new booking. In such cases, cancellation charges will be incurred. We will advise the client if this is the case upon receipt of the request from the client to make amendments.
All initial payments, deposit payments, part payments, payment instalments, treatment fees, administration and service fees are non-refundable and non-transferable regardless of any circumstances be it medical or otherwise. It is the client's responsibility to ensure that all party members are aware of this condition.
We will not be liable to provide you with either a refund or any compensation in the event that you and/or your group fail to present yourself for a particular service or activity that you have booked, regardless of the reason for your failure to present yourself (either on time or at all); unless this failure arose as a direct result of our negligence or that of our employees acting in the course of their employment.
OUR RESPONSIBILITIES.
We will use all reasonable care in the selection and use of suppliers of events and activities forming part of the agreed booking. To the best of our ability, we will ensure the suppliers provide a suitable, professional, legal and safe environment for the client.
Our responsibility is to ensure the elements that make up the event you have booked with us are booked with the suppliers and available to you. We arrange contracts for accommodation and other arrangements and events through suppliers who we have taken reasonable care to make sure have good reputations and run safe and efficient businesses. We will monitor and control the performance of our suppliers and judge their performance against the standards and customs in the region where these services are provided.
We are not responsible for any damaged, loss or intoxication caused by any of our suppliers.
It is your responsibility to inform the supplier, restaurant, hotel or any other, about any special attention that you will need and to check previously to any activity that your personal conditions are satisfactory to carry out the activity.
SOLISOL does not accept liability in the following circumstances:
Any transport, activities, accommodation and other events are carried out subject to the supplier's conditions of carriage, supply or contract, which will be notified to the client if they differ significantly from standard industry practice or upon the client's request. If any supplier can exclude or limit liability under any international convention or foreign law we will rely on that exclusion or limitation.
Where the cause of loss, damage or injury is due to SOLISOL´s suppliers, subcontractors, servants and/or agents, our acceptance of liability is subject to assignment to it of the claimant's rights against the former and to the claimants co-operating with Solisol Travel any legal action it may take to enforce any right of subrogation or by way of any third party proceedings.
We will offer such help as is reasonable in the circumstances to the group if any member suffers difficulties whilst participating in the booking.
THE CLIENT´S RESPONSIBILITIES.
To ensure that all members of the group are informed about the booking details and these terms and conditions.
To take full responsibility for client side administration and be responsible for the accuracy of information supplied, both prior to the booking and up until after the event has elapsed.
The client must inform SOLISOL in writing of any special requests (for example, special facilities for disabled people, dietary requirements, allergies, medical conditions) which it or any of the group have so that SOLISOL is able to make arrangements, as far as reasonably possible, to cater for them.
Some of the activities provided by SOLISOL as part of a booking require an element of physical activity on the part of the group. The client will ensure that all members of the group are physically able to take part in the booking, suffer no disabilities or conditions that may impair, restrict or endanger their involvement or that of other members of the group's involvement in the booking If the client has any doubts or concerns regarding any member of the group's participation in the booking these issues must be raised in writing at the time of booking, (for example asthma, high blood pressure, heart conditions, vertigo).
We insist that you arrange holiday insurance for all of your party when you attend an event. We think this is very important. We are entitled to assume that either you have arranged your own cover or you are prepared to take the risk of being uninsured. Insurance cover will be subject to the policy conditions and any exemptions or excesses mentioned in your policy. It is therefore the responsibility of the client to ensure that adequate holiday insurance cover is provided for the group.
To agree and progress with all payment timetables as set out above and on the booking confirmation email.
To ensure that all members of the group comply with all activity/element timetables of the booking. Failure to keep to the timetables may result in either discontinuation of the event/activity or cancellation of the booking in either event. We will not be liable for any refund, compensation or any other costs that may be incurred.
To ensure that all member of the group are available to travel to Spain.
INSURANCE.
You must take out fully comprehensive travel insurance (it is your responsibility to advise the group members attending to do the same). This can be obtained through a third party insurance provider. It should cover you in the event of cancellation against loss of deposit or cancellation fees, for medical costs in the event of you becoming ill or having an accident whilst on holiday and any lost or stolen possessions (including baggage). There are some restrictions on insurance, for example pre-existing medical conditions and you should advise the insurance provider of these at the time the policy is taken out. It is your responsibility to ensure that the insurance cover you purchase is suitable and adequate for your particular needs.
HEALTH.
Some activities and pursuits carry inherent risks to the client's safety and wellbeing. A client wishing to participate in activities which carry an inherent risk may be asked to sign an additional waiver form by the local supplier. 'It should be understood that participation is at the individual's own risk and it is your own responsibility to obtain the relevant insurance.'
BEHAVIOUR.
SOLISOL, by itself or its suppliers may end or cancel the booking, with no liability of reimbursement, if the behaviour of the group or that of any person associated with the group is likely in the opinion of us or its supplier's to cause distress, damage, danger to or to annoy other customers, or other members of the group, employees, property or anyone else. If the party is found to be behaving in a way that results in affecting the standard performance of our suppliers and enjoyment by other guests, groups may be required to leave the premises - if this is the case groups will immediately forfeit all costs and any right to compensation, whether or not the booking has been completed, and be liable for any compensation sought by our suppliers. If groups behave in such a way that results in the suppliers relationship with us being terminated, clients will be pursued for compensation by SOLISOL.
If the group is prevented from traveling because any person in authority thinks any member of the group appears to be unfit to travel or likely to cause discomfort to or disturb other passengers, we will not be liable to complete the booking arrangements and will not be liable for any refund, compensation or any other costs incurred by the group. We cannot accept liability for the behaviour of others in your accommodation and/or taking part in any activity and/or event associated and/or in the same environment forming part of the booking, or if any facilities or events are removed as a result of their action. In some instances, groups may be required to sign agreement forms and/or provide a damage and/or behaviour deposit. If any occurrence of damage is obvious, groups will be pursued for recovery for the full amount of damage reimbursement, associated costs and any expenses incurred, including time and administration, in pursuing this recovery.
COMPLAINTS.
If there are any complaints about the booking these must be communicated immediately to us or the suppliers who will try to resolve the problem to avoid it spoiling the booking. Any failure to report such complaints immediately will be deemed to be a failure on the part of the group to mitigate its´ losses and we will not consider it liable for those complaints.
If we or our suppliers are unable to sort out the problem then a written report must be submitted, specifying any perceived failure at the place where the booking is supplied.
If the matter is still not resolved after completion of the booking then the client must write to us within 7 working days of completion of the booking giving full details.
INTELLECTUAL PROPERTY.
All software, design, textual, graphical and other content created by or for us, compromised and appearing on this Website and the selection and layout of this Website, are owned or licensed by us and are protected by Spanish and European intellectual property laws. We own the copyright in the Website as a collective work and/or compilation and in the selection, coordination, arrangement and enhancement of such content. Republication or citation of any content generated by the Website without our written consent is expressly prohibited. This Website may contain other proprietary notices and copyright information, the terms of which must be observed and followed.
You may view and electronically copy the pages of this Website in the usual operation of your web browser in visiting this Website but for no other purpose. Any other use of the material contained on this Website such as copying, distributing, selling, modifying, transmitting, reusing, re-posting or publishing is strictly prohibited without our specific written permission. In compliance with the Personal Data Protection Act (Ley Orgánica 15/1999, de 13 de Diciembre, de Protección de Datos de Carácter Personal and Reglamento 2016/679), SOLISOL informs that the user is entitled, at any time, to access the above referred data regarding him or her and to rectify them, cancel them or oppose them, sending a letter with the reference "Data Protection" to SOLISOL accompanying a copy of your National Identity Document addressed to info@solisoltravel.com. The affected users can exercise their rights attaching their ID scanned and sending it by email at the following address: info@solisoltravel.com.
AGREEMENT.
These Terms and Conditions are in place to ensure the smooth running and enjoyment of your weekend. We think that the above terms and conditions are fair. The Terms and Conditions are governed by Spanish Law. The Courts of Málaga, Spain shall have exclusive jurisdiction in connection with any dispute arising out of any booking made with Solisol Travel S.L.
If you make a booking with Solisol Travel S.L. it is understood you have read, understood and accepted these Terms and Conditions. It is the sole responsibility of any person(s) booking with SOLISOL to communicate these Terms and Conditions to all participants of an event.
USE OF THIS WEBSITE.
